These Terms of Service ("Terms") govern your access to and use of DeepNode's website, platform, APIs, CLI tools, and related services (collectively, the "Services") provided by DeepNode ("DeepNode," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms.
By creating an account or using our Services, you confirm that you are at least 16 years old and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Certain features of the Services may be offered as a public beta ("Beta Services"). Beta Services are provided "as is" and may be modified, suspended, or discontinued at any time without notice. We make no guarantees regarding the availability, reliability, or performance of Beta Services. Beta Services may contain bugs or errors, and we encourage you to provide feedback to help us improve.
You agree not to use the Services to:
You retain all rights to the models, data, code, and other content you upload to the Services ("Your Content"). By using the Services, you grant DeepNode a limited license to host, process, and transmit Your Content solely to provide and improve the Services. We will not use Your Content to train our own models or share it with third parties except as necessary to provide the Services.
The Services, including all software, documentation, branding, and content created by DeepNode, are owned by DeepNode and protected by intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or branding without written consent.
For Pro and Enterprise customers, we target 99.99% uptime for production deployments. Uptime is calculated monthly, excluding scheduled maintenance (announced at least 48 hours in advance). Specific SLA terms, including service credits for downtime, are available upon request for Enterprise customers.
We process your data in accordance with our Privacy Policy. For customers subject to GDPR or similar data protection regulations, a Data Processing Agreement (DPA) is available upon request.

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
These Terms are governed by applicable law. Any disputes arising from these Terms shall be resolved through good-faith negotiation or, if necessary, binding arbitration.
We may modify these Terms at any time. We will notify you of material changes by email or through the Services at least 30 days before they take effect. Your continued use of the Services after the effective date constitutes acceptance of the modified Terms.
